This website and online store are operated by Shanghai IOTARS Co., Ltd. under the Kalmix brand.
Throughout these Terms of Service, “Kalmix,” “we,” “us,” and “our” refer to Shanghai IOTARS Co., Ltd. These Terms govern your access to kalmixtech.com and your purchase and use of products and services offered through the website.
By visiting the website or placing an order, you agree to these Terms of Service, our Shipping Policy, Return and Refund Policy, and Privacy Policy.
1. Eligibility and Accounts
You must have the legal capacity to enter into a binding agreement in your jurisdiction to place an order.
You are responsible for maintaining the accuracy of information submitted through the website and for keeping any account credentials confidential. You must promptly update your contact, billing, and delivery information when it changes.
2. Product Information
We make reasonable efforts to present product descriptions, specifications, compatibility information, photographs, prices, availability, and delivery estimates accurately.
GNSS performance, positioning accuracy, convergence time, communication range, and other technical results can vary depending on satellite visibility, correction service availability, antennas, installation, environmental conditions, firmware, host devices, networks, and operating methods.
Statements such as centimeter-level accuracy describe performance achievable under suitable operating conditions and are not a guarantee of identical performance in every environment.
If information on a product page differs from a general policy page, the current product page controls for product-specific specifications, included accessories, warranty periods, dispatch estimates, and promotional terms.
3. Orders and Acceptance
Submitting an order does not by itself constitute final acceptance. We may verify payment, delivery information, product availability, export restrictions, and suspected fraud before accepting or fulfilling an order.
We may decline or cancel an order for legitimate reasons, including product unavailability, inaccurate pricing, payment failure, delivery restrictions, suspected fraud, or applicable trade and export-control requirements.
If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled item or order.
4. Permitted Product Use
Kalmix products may be purchased for personal use, education, research and development, professional fieldwork, commercial integration, or approved OEM and project applications, subject to the applicable product documentation and any separate written agreement.
Resale under the Kalmix brand, alteration of product identifiers, representation as an authorized Kalmix distributor, or use of Kalmix trademarks requires our prior written authorization.
Customers are responsible for determining whether a product is suitable, lawful, certified, and safe for their intended application and location.
Kalmix products must not be used as the sole means of control or navigation in safety-critical applications where product failure could reasonably result in death, personal injury, or severe property or environmental damage, unless expressly approved in a separate written agreement.
5. Prices, Payment, Taxes, and Duties
Prices are displayed in the currency shown on the website or during checkout. Prices, promotions, availability, and product configurations may change before an order is placed.
Standard shipping is included in the order price for destinations available at checkout. The final product price, discount, and delivery estimate will be displayed before payment is confirmed.
Kalmix ships eligible orders on a Delivered Duty Paid (DDP) basis. Applicable import duties, import taxes, brokerage charges, and customs-clearance charges required for delivery are included in the order price and are the responsibility of Kalmix, not the customer.
6. Shipping, Delivery, and Risk of Loss
Shipping destinations, delivery services, processing information, delivery estimates, customs responsibilities, and tracking procedures are described in our Shipping Policy.
Risk of loss or damage remains with Kalmix until the product is confirmed as delivered to the delivery address provided with the order, except where mandatory law requires a different result.
Customers must provide complete and accurate delivery information and cooperate with reasonable requests from carriers or customs authorities.
7. Returns, Cancellations, and Refunds
Return eligibility, return shipping responsibilities, cancellation procedures, and refund timing are governed by our Return and Refund Policy.
Products displayed at a sale, promotional, or launch price are not automatically final sale. A product is excluded from ordinary returns only when the exclusion is clearly disclosed before purchase or when it is a customized, made-to-order, bulk, or OEM product governed by separate terms.
8. Limited Warranty
Unless a different period is stated on the applicable product page, Kalmix hardware products include a 12-month limited warranty beginning on the date of delivery.
The limited warranty covers manufacturing defects arising under normal use. It does not cover normal wear, misuse, accidental damage, improper installation, use outside published specifications, unauthorized repair or modification, liquid damage, external power problems, or failures caused by third-party hardware, software, networks, correction services, or accessories.
For an eligible claim, Kalmix may repair the product, replace it with the same or an equivalent product, supply replacement components, or provide another appropriate remedy.
The limited warranty is provided in addition to any consumer rights that cannot legally be excluded. We do not exclude statutory warranties, guarantees, remedies, or liabilities where doing so is prohibited by applicable law.
9. Software, Firmware, and Third-Party Services
Certain products may depend on firmware, mobile devices, applications, GNSS correction services, communication networks, or third-party platforms.
Third-party products and services are governed by their respective providers’ terms. Kalmix is not responsible for the continued availability or performance of a third-party service that we do not control.
You must not reverse engineer, copy, circumvent security controls, or redistribute proprietary Kalmix software or firmware except where expressly permitted by applicable law or an applicable open-source license.
10. Intellectual Property
Website content, product materials, graphics, logos, photographs, documentation, software, firmware, and Kalmix trademarks are owned by or licensed to Shanghai IOTARS Co., Ltd.
No ownership rights are transferred to you except ownership of the physical product purchased. You may use product documentation as reasonably necessary to install, operate, evaluate, or integrate a purchased product.
11. Prohibited Conduct
You must not use the website or products:
- For unlawful, fraudulent, deceptive, or abusive purposes;
- To violate intellectual-property, privacy, export-control, sanctions, telecommunications, or other applicable laws;
- To interfere with the operation or security of the website;
- To transmit malicious software or attempt unauthorized access;
- To make false claims about affiliation with or authorization from Kalmix.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Kalmix will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the website or products, including loss of profit, revenue, data, positioning availability, or business opportunity.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, breach of mandatory consumer rights, or any other liability that cannot legally be excluded or limited.
13. Governing Law
These Terms are governed by the laws applicable to Shanghai IOTARS Co., Ltd. in Shanghai, China, without regard to conflict-of-law principles.
This provision does not deprive consumers of mandatory protections or dispute-resolution rights available under the laws of their country or state of residence.
14. Changes to These Terms
We may update these Terms to reflect changes to our products, operations, legal obligations, or website. The version published on this page applies from its stated effective date.
Changes will not retroactively reduce rights relating to an order already accepted, unless required by law.
